Terms & Conditions
Terms and conditions aren't exactly the most exciting things to read. But they are important. So please put aside a few minutes to run through them.

Definitions
In these Terms & Conditions, unless the context otherwise requires, the following words shall have the following meanings:
- 'Employees of Virgin Trains' means individuals who work for Virgin Trains under contracts of service.
- 'Membership Card' means a card issued by Virgin Trains signifying that the relevant individual is a Member of Traveller. 'Members of Traveller' means individuals who have agreed to be bound by these Terms & Conditions and 'Membership of Traveller' shall be interpreted accordingly.
- 'Named Stations' means those railway stations in the United Kingdom which are designated by Virgin Trains as being included in Traveller, more specifically the car parking benefit of Traveller.
- 'Programme Partners' means those persons who agree with Virgin Trains to participate in Traveller from time to time.
- 'Traveller' means the scheme operated by Virgin Trains under these Terms & Conditions.
- 'Virgin Trains' means West Coast Trains Ltd. subsidiary of the Virgin Rail Group Ltd 'Virgin Trains Operated Route' means a route between two train stations in the United Kingdom on which trains organised by Virgin Trains run.

Individual residents of England, Scotland and Wales, other than Employees of Virgin Trains, who are aged 18 years or over are eligible to become Members of Traveller.

Virgin Trains reserves the right at any time in its absolute discretion to refuse or revoke Membership of Traveller, provided where, in the case of revocation, it shall use its reasonable endeavours to give the Member of Traveller up to 14 days notice.

Virgin Trains reserves the right to terminate Traveller at any time and for any reason. In this event, it shall use its reasonable endeavours to give each member of Traveller at least 60 days notice.

Virgin Trains operates the West Coast Trains franchise which ends in April 2017. Traveller benefits can be redeemed whilst Virgin Trains operate the West Coast Trains franchise.

The qualification criteria is being reviewed for new members. Until then, Virgin Trains will not be accepting any new applicants.

All members must visit www.virgintrains.co.uk/Traveller to register their new membership. All members are required to check their information, fill in all mandatory fields and upload a photo of themselves.

The person named and photo ID printed on the Membership Card is the only person who may use that Membership Card for any purpose whatsoever. The Membership Card must be signed by the Traveller member to validate the card. Each member is required to upload a photo of themselves when registering their membership. All photos must be a recent colour photograph showing the member's head and shoulders and full front image looking directly at the camera. Photos that are landscape, blurry, dark, obstructed, distant and uncropped will not be accepted.

The Member of Traveller may be asked for a second form of photo I.D by a Virgin Trains staff member should the photo on the membership card is defaced or photo shown differs to the person producing the Traveller card. The Membership Card remains at all times the property of Virgin Trains and must be returned immediately to Virgin Trains if so requested and, in any event, at the end of the Membership of Traveller covered by the Membership Card. Entry qualification or Membership of Traveller end benefits may only be sold, bartered or assigned to other persons if Virgin Trains is notified in writing and gives its prior written consent.

Traveller, and its benefits and qualification requirements, may be amended at any time to comply with applicable laws or regulations and/or for any other reason upon Virgin Trains. Virgin Trains will not be liable for any loss or damage resulting there from. A Member of Traveller will be deemed to have accepted such change or variation if, after receiving written notice thereof, he/she keeps or uses his/her Membership Card. Notwithstanding this, Members of Traveller shall have the right to withdraw from Traveller within 14 days of receiving written notice of any proposed changes if they are not happy with any of the proposed changes.

All Traveller entry qualifications, benefits, credits, and relating offers are available only from Virgin Trains or their nominated Programme Partner, as stipulated. Virgin Trains reserves the right to change the Programme Partners' involvement in Traveller when it deems it necessary or to include more Programme Partners. Entry qualification or other similar credit will only be available from Virgin Trains or its Programme Partners for the duration in which they are participating in Traveller. Notwithstanding this, Virgin Trains shall at all times use its reasonable endeavours to ensure that the Members of Traveller are not adversely affected by any changes in the identity of the Programme Partners.

The Member of Traveller is personally liable for any and all costs, charges, claims or liabilities of whatever nature arising from the use of any of the benefits, facilities or arrangements as provided by Traveller, such costs to include, but not be limited to, any and all car parking charges. The Member of Traveller shall not be so responsible where any of the costs and/or expenses are due directly to the act and/or omission of Virgin Trains and/or are the direct legal responsibility of Virgin Trains.

The Member of Traveller is solely responsible for any tax liability which may arise and for any other fees charged by governmental or non-governmental sources as a result of the Member of Traveller's participation in Traveller and/or the Member of Traveller earning or redeeming any awards or entry qualification.

Entry Requirements
Previous Traveller members who's membership expired from 31 March 2012 will receive a renewed membership which will expire on 8 November 2014. Virgin Trains have the right to refuse any other pre existing members into the scheme whether their membership expired before, during or after 31 March 2012. Please allow 28 days to receive your Welcome Pack, incorporating your Membership Card, and full Membership of Traveller details once the registration page has been completed successfully.

Priority Seating
Seats subject to availability. You may be required to show your Membership Card as proof of Membership of Traveller. Presentation of your Membership Card only entitles you to sit in a Reserved seat in First Class when accompanied by a valid First Class ticket. There are a limited number of seats which will be reserved for Members of Traveller, however, seats may not be available on all trains due to extreme circumstances including, but not limited to, non-availability of the seat reservation system. Seats offered on a first come first served basis. You may be required to relinquish your seat if requested by the Train Manager, under certain circumstances, including, but not limited to where the seat is needed for a disabled person. This facility is exclusive to Members of Traveller.

Priority Car Parking
Named Stations only. Virgin Trains shall have the right to change the Named Stations at any time save that wherever possible it shall give the Members of Traveller 14 days' written notice of any such changes. All car-parking charges still apply. Only those bays marked with the Traveller sign are deemed to be Priority Reserved spaces. Only cars clearly displaying a Traveller Priority Parking Pass are permitted to park in these bays. In any other instance, the car park attendant has the right to remove and/or penalise unauthorised cars under the terms and conditions of that individual car park. Spaces on a first come first served basis. All Members of Traveller have equal entitlement to these car parking spaces. This facility is exclusive to Members of Traveller. Virgin Trains will not cover any charges that may apply in any of these car parks nor is it liable for any fines incurred for parking offences. Whilst in the car park, the rules and regulations of that car park apply. Virgin Trains cannot accept any responsibility for any vehicle parked in any of these car parks and is not liable for any damage or theft that may unfortunately occur as it has no direct control over the car parks.

Free Weekend Leisure Travel
Free Weekend Leisure Travel - Tickets must be booked before 6pm the day before travel. Personal Membership Number of Traveller must be quoted when booking the complimentary tickets and you must show your Membership Card whenever asked to do so by a representative of Virgin Trains, including, but not limited to, when actually travelling. If you don't have your Membership Card when travelling, you will be asked to pay the full fare for the journey. Up to a maximum of 2 adults and 4 children (persons up to and including the age of 15) can travel per Membership Card for £10 return for each child. Children under the age of 5 travel free of charge but do not qualify for an automatic seat reservation. If you wish to reserve a seat for a child under the age of 5 then a £10 supplement must be paid at the time of making the seat reservation. The number of promotional child bookings must be made at the same time as the adult booking. Complimentary tickets and promotional child tickets as part of Traveller must be used by persons travelling together on the same days and on the same trains in both directions. Members of Traveller must be present on the train at all times throughout the entire journey covered by the complimentary tickets. Complimentary tickets must be booked through The Virgin Trains Call Centre (a dedicated number will appear in your welcome pack with your Personal Membership Number) or online at virgintrains.com/traveller. Use of complimentary tickets is exclusively reserved to the relevant Member of Traveller and, therefore, save for those persons on whose behalf you acquire tickets under this clause, under no circumstances must any tickets obtained under this clause be used, sold or transferred in any way. Complimentary and promotional child tickets can only be booked as a return journey. Availability may vary according to route, date and time of travel. Some peak trains have limited or no seat availability. Once you have made a reservation for your complimentary weekend travel, this cannot be changed. Complimentary and promotional child tickets will be valid for use only on selected Virgin Trains services which depart all day Friday, Saturday, Sunday and before midday on Monday. Travel on Monday must be the return portion of an outward journey made on Friday, Saturday or Sunday. Travel on Fridays must include an overnight stay. Complimentary and promotional child tickets can only be booked as a return journey between the same two stations. Travel in both directions must be completed during the same weekend and only one set of complimentary and promotional child tickets per weekend can be booked. Railcards or other discounts may not be used in conjunction with this offer. Proof of posting is not proof of delivery. All travel is subject to National Conditions of Carriage, copies of which may be obtained from ticket offices. The Passenger's Charter does not apply to any free travel awarded by Traveller.

Free Alcoholic Drinks at the London Euston First Class lounge
Offer only available in London Euston Station lounge. Virgin Trains reserves the right to refuse admission to the lounge. Both members and their guest must have a valid First Class ticket to enter the First Class lounge. Free soft/hot drinks available during normal opening hours. Alcoholic drinks will only be served free of charge in the 2 hours up to the Traveller's departure time. Champagne is not included as part of the free drink offer. Persons under the age of 18 are not permitted to purchase drinks or be served alcohol in the lounge. Virgin Trains' lounge staff reserve the right to ask for additional photo identification at any time. All drinks are subject to availability and each Member of Traveller and their one guest is entitled to an unlimited number of drinks. For the avoidance of doubt, Members of Traveller are entitled to have a free non-alcoholic drink instead of a free alcoholic drink if they so wish.

Ongoing and Additional Benefits
Virgin Trains reserves the right to add additional benefits to Traveller, subject to their own Terms and Conditions when appropriate, those terms and conditions being obtained from its website. Virgin Trains also reserves the right to withdraw a benefit when necessary and will attempt to offer an alternative benefit of equal or lesser value whenever possible, however it is under no obligation to do so. Notwithstanding this, Virgin Trains shall at all times use its reasonable endeavours to notify Members of Traveller in writing of any alterations and Members of Traveller shall have the right to withdraw from Traveller within 14 days of receiving written notice of any proposed changes if they are not happy with any of the proposed changes.

These Terms & Conditions shall be governed by and construed in accordance with English law. Virgin Trains and each Member of Traveller submit to the non-exclusive jurisdiction of the English courts to resolve any disputes that may arise out of them.

So far as the law allows, any provision of these Terms & Conditions declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.

Each right or remedy of the parties under these Terms & Conditions is without prejudice to any other right or remedy whether under these Terms & Conditions or not.

Failure or delay by Virgin Trains in enforcing or partially enforcing any provision of these Terms & Conditions will not be construed as a waiver of any of its rights under these Terms & Conditions.

Any waiver by Virgin Trains of any breach of, or any default under, any provision of these Terms & Conditions by the Members of Traveller will not be deemed a waiver of any subsequent breach or default and will in no way affect the other terms of these Terms & Conditions.

These Terms & Conditions will be binding upon and endure for the benefit of the successors in title of the parties.

The parties agree that there is no relationship of partnership, agency or employment between them and that they are not engaging in a joint venture.

For the avoidance of doubt, nothing in these Terms & Conditions shall confer on any third party any benefit or the right to enforce any of these Terms & Conditions which it would not otherwise have had but for the Contracts (Rights of Third Parties) Act 1999.
